SplashyPages Affiliate Program Terms

Company: SPLASHYSTUDIOS LLC ("Company", "we", "us", "our")
Product Covered: SplashyPages only

By applying to or participating in the SplashyPages Affiliate Program ("Program"), you ("Affiliate", "you") agree to the following terms.

1. Program Scope

This affiliate program applies only to SplashyPages subscriptions.

Commissions are not earned on:

  • SplashyScout
  • Other SPLASHYSTUDIOS products
  • One-time services unless explicitly stated

2. Eligibility

  • You must be at least 18 years old.
  • You must provide accurate and complete registration information.
  • We reserve the right to approve or reject any affiliate application at our sole discretion.

3. Commission Structure

  • Affiliates earn a commission on qualifying SplashyPages subscription purchases made through their unique referral link.
  • Commission rates are displayed in your affiliate dashboard.
  • A qualifying purchase is defined as a completed, paid subscription that is not refunded, canceled, or disputed.

We reserve the right to modify commission rates at any time. Changes will not apply retroactively to commissions already earned.

4. Attribution & Tracking

  • Attribution is based on last-click tracking unless otherwise specified.
  • The referral cookie duration is 30 days.
  • Commissions are tracked via your unique referral link.
  • We are not responsible for tracking failures due to ad blockers, browser settings, or technical issues outside our control.

Self-referrals are not permitted.

5. Commission Payment

  • Commissions are paid via PayPal (or another approved payment method).
  • Payouts occur monthly, typically within 30 days after the end of the prior month.
  • There is currently no minimum payout threshold.

We reserve the right to introduce or modify a minimum payout threshold at any time, at our sole discretion. Any changes will apply to future payout periods.

We may delay or withhold payment if fraud, abuse, chargebacks, or policy violations are suspected.

Affiliates are responsible for maintaining accurate payment information.

6. Refunds, Chargebacks & Fraud

Commissions will not be paid on:

  • Refunded subscriptions
  • Chargebacks
  • Fraudulent transactions
  • Self-referrals

If a subscription is refunded or disputed after commission has been paid, we reserve the right to deduct that amount from future payouts.

7. Permitted Promotional Methods

Affiliates may promote SplashyPages through:

  • Personal websites or blogs
  • Social media accounts
  • YouTube or other video platforms
  • Email newsletters (lawful, opt-in lists only)
  • Educational or informational content

All promotional content must be truthful and must not make misleading claims about SplashyPages.

8. Prohibited Activities

You may NOT:

  • Bid on our brand name or variations in paid ads without written permission
  • Impersonate the Company
  • Offer unauthorized discounts or incentives
  • Engage in spam (email, DMs, comment spam, etc.)
  • Use cookie stuffing or tracking manipulation
  • Promote on illegal, adult, or hate-related platforms

Violation may result in immediate termination and forfeiture of unpaid commissions.

9. Intellectual Property

You are granted a limited, non-exclusive, revocable license to use approved SplashyPages marketing materials solely for promotion.

You may not:

  • Modify logos without permission
  • Create misleading brand representations
  • Register domains containing our brand name

All intellectual property remains the property of SPLASHYSTUDIOS LLC.

10. Taxes

U.S. Affiliates

  • Affiliates earning $600 or more in a calendar year must submit a completed W-9 form.
  • A 1099-NEC will be issued where required by law.
  • Affiliates are responsible for reporting and paying any applicable taxes.

Non-U.S. Affiliates

  • You may be required to submit a W-8BEN or W-8BEN-E form.
  • You are responsible for complying with tax laws in your country of residence.

We do not provide tax advice.

11. Relationship of Parties

You are an independent contractor.

Nothing in this agreement creates:

  • Employment
  • Partnership
  • Joint venture
  • Agency relationship

You have no authority to bind the Company.

12. Termination

We may terminate your participation in the Program at any time, with or without cause.

Upon termination:

  • Your affiliate link will be disabled.
  • Unpaid commissions resulting from violations may be forfeited.
  • Lawfully earned commissions prior to termination will be paid according to standard payout terms.

You may terminate your participation at any time by written notice.

13. Limitation of Liability

We are not liable for:

  • Indirect or consequential damages
  • Loss of income or business
  • Tracking errors beyond reasonable control
  • Technical interruptions

Our total liability under this agreement shall not exceed commissions paid to you in the preceding three months.

14. Modifications

We reserve the right to update these terms at any time.

Continued participation in the Program after updates constitutes acceptance of the revised terms.
